After being present for the calendar call, Dr. William Mitchell and his attorney were made aware that the state would like to make a motion to strike a portion of the evidence they suspect Mitchell and his defense to use.Judge Weaver told the state and defense attorney to get all of their motions in and once a decision was made on the motions that a trial date would be set.
Dr. Mitchell wants a jury trial and feels strongly that he will better off taking his chances with a jury instead of accepting the plea of a $50 fine and 2 years of probation that was offered to him by the district attorney’s office.
