$50,000 bond set for Chamaty and Havard in connection with the murder of Justin McKinney

Blue Ridge, Ga. – “What I am going to do here, is I am going to set bond at $50,000,” Appalachian Judicial Circuit Superior Court Judge Brenda Weaver made her ruling and granted bond for Michael Chase Havard age 20 and Kevin Jack Chamaty age 20, both of whom have been charged in connection with the murder and Justin McKinney and assault of Anna Franklin.

The terms of the bond are strict with both men being required constant supervision and a host of stipulations that if not followed will result in immediate arrest.

The courtroom was packed in Pickens County as the two young men each had lawyers present their case for being allowed bond.

Appalachian Judicial Circuit District Attorney B. Alison Sosebee recounted the events that led to the arrest of Havard and Chamaty in a written statement given by Georgia Bureau of Investigation (GBI) Special Agent Jamie Abercrombie.

According to Abercrombie both men knew of the conspiracy to murder and rob McKinney and aided in the act by providing gas and rides the night of the incident on Dec. 4, 2018 and also helped in disposing of one of the weapons used in the crime.

The GBI learned of the young men’s involvement after Havard voluntarily came forward and spoke with investigators about his knowledge and the roles that he and Chamaty played in the events surrounding the case.

Chris Hyde, Chamaty’s stepfather, was first to take the stand. Questioned by Defense Attorney Brian Steel, Hyde was firm in his belief that if granted bond Chamaty would return to court to face trial: “I believe 100 percent he would return, without hesitation.”

While Hyde is no longer married to Chamaty’s mother, Christy Hyde, Christy still resides in the home with Hyde and is currently serving 15 years probation for a methamphetamine and weapons charge in 2015. It was pointed out that Chamaty’s mother is serving under the First Time Offenders Act.

Gerald Patterson, who resides with Chamaty’s grandmother Rachel Newman, also took the stand to testify on behalf of Chamaty receiving bond.

Patterson who has resided with Newman for approximately 5 years, spoke of his belief that Chamaty does not pose a threat to the community, and like Hyde was willing to “put up his wealth” as a guarantee.

Sosebee took the court off guard as she questioned Patterson: “Is this the same Ms. Newman (Chamaty’s grandmother) that was convicted in 1990 of voluntary manslaughter for the shooting death of her ex husband?”

“Yes ma’am it is,” Patterson replied to Sosebee’s question.

Chamaty, himself, does have a prior record with law enforcement, but the nature of his charges were never fully disclosed in court. Despite Chamaty having a family with a history of run ins with the law, many supporters were present for the young man.

After testimony from Hyde and Patterson, neither of whom have criminal backgrounds, Defense Attorney Steel turned to the courtroom gallery and asked those there to support Chamaty to please stand: “If you would do me a courtesy, if you would please stand in your place if you have come here today to support bond being granted for Mr. Chamaty.”

Approximately 30 people rose and remained standing as they testified their belief that Chamaty would in fact return to court and does not pose a threat to the community. Chamaty became visibly emotional during this phase.

“Nobody is in any way diminishing the loss of life for any person or living creature, but here we stand before the court in a position where Mr. Chamaty is cloaked with the presumption of innocence,” Steel concluded his case and pointed to the fact that Chamaty had followed a legal process in dealing with this case thus far and had voluntarily turned himself in.

Sosebee argued for the court to deny bond questioning why a 20 year old would be living with a 16 year old (Lakota Cloer : co-defendant in the case) and pointing to lack of accountability by the family prior to the incident.

“There are several juveniles in this court right now,” Sosebee said explaining that Chamaty’s pattern of behavior was likely not to change. “As a matter of fact we have the sister of Lakota Cloer who present in the gallery now, here in support of Mr. Chamaty. The connections, the continuation that Mr. Chamaty has with the witnesses in this case have not ceased.”

Sosebee added that while Chamaty had voluntarily turned himself, he had also “voluntarily facilitated the commission of those acts” in the crimes he is alleged to have participated in on Dec. 4.

Ultimately, Weaver granted bond set at $50,000. Along with this bond, Chamaty must be under constant supervision from Mr. Hyde including going to work.

“Mr. Hyde now has a shadow on him,” Weaver said of her ruling, “I am putting the burden on Mr. Hyde.”

Chamaty will be under house arrest and only allowed to leave with Mr. Hyde for work, church, medical or legal appointments. Chamaty will also be subjected to random drug testing in which he must call every morning to find out if he will be tested that day.

No contact with victims or co-defendants including co-defendant’s families will be allowed, and a curfew of 8 p.m. is set in place. Both Hyde and Patterson put up their personal property to insure the bond.

Havard’s terms of bond were very similar to the parameters set in place by Weaver for Chamaty’s bond.

Havard’s father, Chris Havard, spoke on his son’s behalf. He explained that his son had contacted him regarding the events that took place on Dec. 4 and that he had advised his son to go to the police in which Havard did almost immediately.

Havard, after speaking with investigators, then went to stay with his father who resides in Raleigh, Nc. According to Chris Havard, “I decided to pick him up and bring him to Raleigh.”

When the young man was informed of a warrant out for his arrest, Chris Havard made arrangements for his son to voluntarily turn himself in: “I personally drove him there (back to Fannin County).”

Havard’s father explained that while he would like for his son to return with him to North Carolina if granted bond, he understood that that might not be possible and had made arrangements for his son to live with his grandmother in Ellijay, Ga.

Diane Conway, Havard’s grandmother took the stand to confirm that she would take responsibility upon Havard’s release.

Conway admitted to being very upset by the events that have taken place but still would do anything to help her grandson: “I believe in him.”

Despite her belief in her grandson, she also has a firm belief in the law and when questioned whether she understood that if Havard violated any of the terms of the bond that he would be placed under custody she nodded and replied, “I would report him,” and added “He’s just going to have to go with me wherever I go. I have no problem with it.”

Judge Weaver expressed her thoughts on the responsibility of all involved in the case.

“If he’s to work, I don’t know how I would do that. I would just have to keep him at home with me,” Conway did express concern about being unable to supervise him on a job.

The court handed down the same stipulations of bond that were set forth for Chamaty with the exception that the bond could be amended if Havard gained employment and at a minimum would be required to where an electronic monitoring device while at work.

Both Conway and Chris Havard put up personal property to insure Havard’s bond. All insurances by both families will need to be approved by the Fannin County Sheriff’s Office prior to release.

The bond issued will also cover any further charges that might be handed down by a Grand Jury.

Judge Weaver shared her thoughts on the circumstances surrounding the McKinney murder case: “Frankly, I’m just not real happy with the parents or grandparents of any of these children. In every one of these defendants, these children were basically let go their entire life. Which we don’t do that as parents.”

“None of this should have ever occurred because somebody should have known where these kids were,” Weaver continued to address the court, “That’s not how you raise children. I think every bit of this could have been prevented if the parents were just exercising what they should be doing as parents to begin with, which is knowing where there children are on a school night at 1 o’clock in the morning.”

All suspects are expected to face a Grand Jury soon in Fannin County and move forward to trial.

$1,000,000 in savings. Public Works cuts budget and raises productivity.

Blue Ridge, Ga. – “I believe that smaller government is better government, but I also believe that in areas where government does play a legitimate role we should demand that it is done better.” Former Governor of Wisconsin, Scott Walker spoke these words that echo true in the thoughts of many Americans across the nation. Here at home, in Fannin County, we are seeing the literal effects of these words when put into action.

Zack Ratcliff, Director of Public Works in Fannin County, has not only managed to cut the department’s expenses by close to $1,000,000 in just two years but his management has also led the Public Works department to more than double productivity in many areas.

In 2016 the Public Works department had 53 employees with a budget of $1,826,505 in payroll alone. The number of employees dramatically decreased by 2017 to 35. This brought payroll expenditures down to $1,308,744.

By 2018 employee total for the department sits at 36 with a payroll of $1,289,868. This alone has brought a little over $500,000 in savings to taxpayers each year.

“Any time you have change in administration or management there has always been that old fear, you hear that term cleaning house, you (Ratcliff) didn’t do that,” Fannin County Chairman Stan Helton said clarifying what allowed Ratcliff to make these cuts in payroll. “What you came out there and did, you set a standard of what was expected of employees.You raised the bar.”

Ratcliff confirmed Helton’s statement by saying that upon becoming the Director of Public Works he has only had one termination in the department.

With the department now having roughly two-thirds of the employees held in 2016, one would assume productivity or quality would be lacking, but Public Works has sacrificed neither of these by streamlining the department, and the number of jobs completed each year is actually on the rise.

In the last year, roughly 117 miles of road have been restriped, 12 miles of road have been paved, 25 miles of road have been chip and sealed, the Aska Transfer Station also received chip and seal, as well as the Recreation Center parking area, 28 culverts have been installed, 600 road signs have been cleaned and straightened, and 649 new road signs were created for use throughout the county.

Fannin County Post 1 Commissioner Earl Johnson commented on how this kind of productivity saves money for residents: “The numbers that I see that aren’t reflected in these numbers, of other savings, is when you chip and seal a road, that is that many roads we’re not having to gravel, to grade or to maintain, other than clogged ditches and what have you. So really it’s hard to put a number on that (indirect savings).”

Ratcliff has also managed to cut costs by strategically coordinating work done throughout the county. By coming up with a well mapped plan for the year, the department has cut time and fuel by focusing on specific areas within the county to complete multiple projects.

Along with cutting costs, Ratcliff has added over $85,000 back to the county’s General Fund through selling the department’s older vehicles and equipment.

While the payroll is the most dramatic of the savings, other areas have improved in expenditures as well. The Fuel Master system was installed to track fuel use leading to greater accountability, through negotiations with various vendors the county is now receiving 2-10 percent discounts on its bills, and a new uniform provider was found that can provide uniforms at half the cost that the county was previously paying.

Ratcliff credits the success of the Public Works department to the employees in it and stated of the workers, “My crew is an efficient crew. Everybody’s professional.”

Johnson spoke of the dramatic affect one department can have on Fannin County as a whole, “These numbers right here is what keeps Fannin County’s millage rate the lowest in the state.”

“I think this is a great example of being able to professionally manage a department and do it effectively,” Helton added his thoughts on the accomplishments of the Public Works department, “That’s real money. That’s big time money.”

The 2017 audit showed the initial savings of the now more efficient Public Works department as being $999,333.

When asked what motivates him to continue to look for ways to improve the department and save taxpayers money Ratcliff simply replied, “I’m a public servant.”

Discussions continue over Board of Education $250,000 land purchase

BLUE RIDGE, Ga. – After news spread of the Fannin County Board of Education’s recent approval to purchase one acre of land on Highway 515 for a price tag of $250,000, citizens questioned the necessity of this purchase and inquired about the legalities of its use.

Fannin County School Superintendent Dr. Michael Gwatney, along with Fannin County Attorney Lynn Doss and Fannin County School System’s Director of Facilities and Maintenance Danny Shinpaugh, sat down with FetchYourNews to answer questions and address concerns over this purchase.

This one-acre plot of land, which will serve as a connector to the school system’s new agricultural development positioned off of Ada Street, is located along Highway 515 between Windy Ridge Road and Josh Hall Road.

Main entrance to agricultural campus will be shared with Fannin County’s new fire station and E-911 center.

Doss explained that the 31 acres off of Ada Street has been under the ownership of the Fannin County School System for many years: “The school system has owned that property for about 15 years.”

According to Doss, the Ada Street land was originally purchased in 2006 with plans to build a new school if the need arose. The land itself was centrally enough located and met state requirements at that time for a new school.

Since the need for a new school never came to pass, the school system, over the years, have looked at a number of ways in which to utilize this property and, in recent years, decided that it would be ideal for an agricultural facility.

The property currently has an entrance/exit along Ada Street, but Gwatney pointed out that it would be used very minimally and primarily in the event of an emergency.

The property’s main point of access is along the Windy Ridge Connector, where the school system has partnered with Fannin County, and a roadway will be shared with the new fire station and allow access to the agricultural facility.

Questions arose about the need for the acre of land located on Highway 515 and the logistics of its use after Gwatney released a statement explaining the purchase.

In the statement, Gwatney said, “If you hear that our school system paid $250,000 for an acre of property, it is true; however, there is more that you need to know about this purchase, and I want you to have the facts.”

Gwatney also pointed out in the same statement that district personnel, including himself, has already met with the Georgia Department of Transportation (GDOT), and it has been determined that a deceleration lane may be placed ahead of the existing entrance to the property on Hwy. 515.

No official approval has been granted to the school system to make changes to the property in the GDOT right of way, but a GDOT representative did confirm with school officials that these changes were possible.

Gwatney clarified about circumstances of the possible deceleration lane: “We just wanted to make sure whether it was feasible, and that’s what we talked to GDOT about.”

In order for any improvements to be made to the entrance of the property, including a deceleration or an acceleration lane, permission would have to be granted from GDOT and special permits would need to be obtained by the Fannin County School System.

Fannin County School System’s Director of Facilities and Maintenance Danny Shinpaugh confirmed that any of these improvements would have to be carried out by GDOT-approved contractors and engineers and meet GDOT-approved standards and plans.

According to the GDOT Regulations for Driveway and Encroachment Control, a right turn lane may be required of the school system in order to use this property as an entrance: “Right turn deceleration lane must be constructed at no cost to the Department if the daily site generated Right Turn Volumes (RTV) based on ITE Trip Generation (assuming a reasonable distribution of entry volumes) meet or exceed” 50 right turns into the property daily.

Ownership and maintaining of a deceleration lane after completion is also described in the GDOT regulations as: “The R/W for accel/decel lanes may be dedicated in fee simple to the Department for the Department to maintain or the applicant must sign an agreement with the Department to maintain the lane to the Department’s standards and to hold harmless the Department in the event that section of roadway is identified in any liability action.”

While the addition of the deceleration lane could be an expensive venture for the school system, Gwatney stated that there are currently no plans to implement the right turn lane, and the main reason for the purchase of the property was for direct Hwy. 515 access and to allow for a variety of options in traffic control onto and off of the land.

“We would have acquired this property without that (deceleration lane),” Gwatney said, explaining the school system’s stance on the purchase. “It wouldn’t be near the worth if we couldn’t do that.”

A question also arose pertaining to whether the property’s existing entrance was already zoned for commercial use, as getting a commercial entrance onto Hwy. 515 could be difficult and costly.

According to the GDOT regulations, in the case of Non-commercial Driveways “a driveway serving a school, government building, church, hospital or other non-commercial organization inviting public use. Design guidelines relating to commercial driveways will be applicable to driveways serving these land uses.”

However, Fannin County Attorney Lynn Doss said that this is not a concern for this project: “It’s not a thing where we are because we’re outside of the city limits. In the county, we don’t have zoning, so we have no commercial, residential or industrial.”

While the plans for the one-acre tract are yet to be determined, Gwatney suggested some possible uses. The land could serve as an exit from the facility for southbound traffic turning right onto Hwy. 515, and the main entrance off of Windy Ridge Connector would serve as an exit for northbound traffic allowing this traffic access to a traffic light in order to turn left onto Hwy. 515.

Another plus noted by both Gwatney and Shinpaugh in relation to purchasing this land is the use of the existing buildings on the property.

“The school system is always hurting for storage,” Shinpaugh noted.

The property currently has 18 storage units, all of which have the space to house large equipment. These buildings will be put to use by the school system.

As for the purchase of this tract, Gwatney explained that it was not needed for the land’s original purpose in 2006, but as the purpose of the land changed, so did the needs to accommodate the facility: “It makes our existing project better.”

The new agricultural facility is expected to be completed by June 30 of this year.

Board of Education agrees to purchase commercial tract for $250,000

BLUE RIDGE, Ga. – At a special called Fannin County Board of Education (BOE) meeting held March 22, the board unanimously agreed to purchase commercial land located on Highway 515.

The one acre property is located between Windy Ridge Road and Josh Hall Road.

This one-acre plot of land, which will serve as a connector to the school system’s new agricultural development located off of Ada Street, was purchased by the board for an agreed upon price of $250,000.

A statement released by Fannin County School Superintendent Dr. Michael Gwatney explains the circumstances behind this purchase: “If you hear that our school system paid $250,000 for an acre of property, it is true; however, there is more that you need to know about this purchase, and I want you to have the facts.”

The district currently has an easement beside the site of the new Fannin County Fire Department Fire Station 1 (off of the Windy Ridge Connector) that has been utilized to access the 31+ acres of land located off Ada Street.

“This new tract will connect our existing acreage and provide us with a continuous piece of property connecting directly to Highway 515,” Gwatney explains.

“This second Highway 515 access will be a safer and quicker way to enter our agricultural facility, and it will alleviate the need for visitors to travel to the Windy Ridge Connector,” Gwatney said in his statement.

The new tract of land is located along Highway 515 between the Windy Ridge Connector and Josh Hall Road.

Fannin County BOE agrees to purchase commercial tract for $250,000

Entrance to the property is located just beyond the Windy Ridge overpass heading south on Hwy. 515.

Gwatney pointed out that district personnel, including himself, has already met with the Georgia Department of Transportation, and it has been determined that a deceleration lane may be placed ahead of the existing entrance to the property on Hwy. 515.

Gwatney explained, “This deceleration lane will help safely ease the transition off Highway 515 for our buses, student drivers, and large vehicles that may be towing trailers.”

The property is owned by AAH Properties of Blue Ridge, LLC. who purchased the tract in 2006 for $380,000. According to Gwatney, it is also important to note that “all usable commercial frontage on Highway 515, especially with an access road already in place, is quite valuable.”

This tract of land has buildings that are currently being used commercially and these buildings along with signage will become property of the Fannin County School System.

The terms in the selling contract states that closing on this property will occur within 90 days of the termination of current tenant leases. The purchase of this property will come from Education Special Purpose Local Option Sales Tax (ESPLOST) funds allocated to the Fannin County School System.
